Terms & Conditions
All services provided by Fontive Design Studio are subject to the following terms and conditions. By purchasing any of our products or services, you are agreeing to these conditions:
All fees and costs are estimated. Changes in scope of work and/or project specifications require a revision of the information provided. Estimates are valid for a period of 15 days only.
There will be three proposals made for each logo design. Any proposal after that may start from $70 each. Once a proposal of graphic art design has been chosen, a round of 3 revisions will be included in the original agreed upon price. Any revision thereafter will incur in additional charges.

Client agrees to pay Fontive Design Studio on the date of the Design Studio's billing, which shall be the date of approval of the Designs unless a different agreement has been made. In the event that work is postponed at the request of the Client, the Design Studio shall have the right to bill pro rata for work completed through the date of that request, while reserving all other rights under this Agreement. Overdue payments shall be subject to interest charges of ten percent monthly.
Any service or graphic art must be paid in full on the date of the order, unless the order is equal to or greater than $200. In this case a deposit of 75% for printed products or 50% for graphic design work must be paid on the order date, and the remaining balance must be paid in full the date the project is approved. All invoices are payable via cash, check or bank transfer.
For each non-sufficient funds check, a fee of $35.00 will be charged. If we must travel to your location for a second payment, a convenience fee will also be assessed. In the event of cancellation by the Client, the following cancellation payment shall be paid by the Client: (A) Cancellation prior to the Designs being turned in: 40% of the fee; (B) Cancellation due to the Designs being unsatisfactory: 50% of fee; and (C) Cancellation for any other reason after the Designs are turned in: 60 percent of fee. In the event of cancellation, Fontive Design Studio shall own all rights of the Designs. After the product has been printed there is no refund of the total purchase price.
Upon receipt of full payment, the printed material delivered to the Client shall become the property of the Client. The ownership of removable electronic storage media and of original artwork, including but not limited to sketches and any other materials created in the process of making the Designs as well as illustrations or photographic materials such as transparencies, shall remain with the Design Studio. The original source files will remain with the design studio unless an arrangement of transfer of rights and any 'buy-out' charges have been paid.
You may not use or reproduce the designs or the images there in for a purpose other than the one(s) originally stipulated. If you wish to use the design we have created and/or the images within it for another purpose or project, including a reprint or exhibition, you must contact us to arrange the transfer of rights and any additional fees before proceeding.
The client unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to Fontive Design Studio for inclusion in the design or web design projects are owned by the client, or that the client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, and defend Fontive Design Studio from any claim or suit arising from the use of such elements.
The Client agrees to Fontive Design Studio's definition of acceptable means of supplying data to the company. Text is to be supplied in electronic format such as Standard Text (.txt), Microsoft Word (.doc) or via e-mail. Images that are supplied in an electronic format must be of a quality suitable for use without any subsequent image processing. Fontive Design Studio will not be held responsible for any image quality which the Client later deems to be unacceptable due to low resolution or required scanning from a printed source. Additional expenses may be incurred for any necessary action, including, but not limited to, photography and art direction, photography searches, media conversion or digital image processing.
A down payment is required in order to begin development of your website. This is usually 50% of the upfront design fee, unless an alternative contract or proposal specifies a different amount. The outstanding balance on your website is due after the design, navigation and pages have been approved and built. Fontive Design Studio will upload an optional "under construction page" until the complete digital text has been received by the client.
This cost recurs annually through automatic billing. Domain name registration gives you exclusive rights to a certain name, such as www.yourcompany.com, so that you can use it for your web-based purposes. You are not required to register a domain through us, but we strongly prefer that you do. If you have registered your own name, make sure you have yourself as the Registrant and Administrative Contact with a current email address. Access to this information is necessary and must be provided in writing by the client. This will help ensure that your domain can be renewed or transferred should the need arise. Domain name registration fees are non-refundable.
This cost recurs annually through automatic billing. Hosting places the domain name on a particular server connected to the web, which allows you to post a website for viewing through a browser. You are not required to host through us, but we strongly prefer that you do. Hosting comes with domain-based emails, bandwidth, storage space, database, security tools and other features. Projects that involve custom programming must be hosted with Fontive Design Studio to ensure the website will function properly. If you wish to host your site on another server access to the username and password must be provided in writing.
There are no required maintenance fees other than domain registration and hosting. Fontive Design Studio will provide free maintenance for two months after the site goes live. Any maintenance or revisions needed after this time period will be billed at $20/hour. No maintenance fees will be charged if no changes or updates are necessary.
Fontive Design Studio does not guarantee any specific position in search engine results for your website. We perform basic search engine optimization according to current best practice.
You agree to reimburse Fontive Design Studio for any requested expenses which do not form part of our proposal including but not limited to the purchase of templates, third party software, stock photographs and fonts.
You are responsible for maintaining your own backups with respect to your website and we will not be liable for restoring any client data or client websites except to the extent that such data loss arises out of a negligent act or omission by Fontive Design Studio.
You are responsible for complying with all relevant laws relating to e-commerce. To the full extent permitted by law will hold harmless, protect, and defend and indemnify Fontive Design Studio and its subcontractors from any claim, penalty, tax, tariff loss or damage arising from your or your clients' use of Internet electronic commerce.
If site design and development work has already begun, the down payment is non-refundable. Fontive Design Studio may elect at its sole discretion to offer a partial refund depending upon the circumstances.
